17. aprila 2019 je bila sprejeta Direktiva (EU) 2019/790 Evropskega parlamenta in Sveta o avtorski pravici na enotnem digitalnem trgu, katere namen je prilagoditev nekaterih izjem avtorske pravice v digitalnem in čezmejnem okolju ter zagotavljanje širšega dostopa do digitalnih vsebin. Nekatere spremembe so pomembne tudi za področje knjižničarstva, predvsem ko gre za ohranjanje kulturne dediščine.
Na spletnem dogodku so gostje iz tujine in Slovenje predstavili izkušnje s prenosom Direktive v nacionalni pravni red in ključne spremembe, ki jih prinaša Direktiva.
V prvem delu dogodka, ki bo potekal v angleškem jeziku, so sodelovali:

Drugi del je potekal v slovenskem jeziku in je bil namenjen predvsem vsem zainteresiranim knjižničarjem. Predstavljen je bil vpliv implementacije DSM direktive in pričakovane spremembe Zakona o avtorski in sorodnih pravicah, ki bodo zadevale oziroma lahko vplivajo na vsakodnevno prakso dela v knjižnici.
On 17th April 2019, the Directive (EU) 2019/790 of the European Parliament and of the Council on copyright in the digital single market has been adopted; its aim is to adjust certain copyright exceptions in the digital and cross-border environment, and to ensure a wider access to digital content. Some changes are relevant also to the field of librarianship, especially in regards to preservation of cultural heritage.
At the online event, guests from abroad and Slovenia presented their experience with transposition of the Directive into national legislation and key changes brought by the Directive.
Stephen Wyber (IFLA), Paul Keller (Open Future), Szabolcs Dancs (National Széchényi Library of Hungary), Christopher Natzén (National Library of Sweden), Maja Bogataj Jančič (Institute for Intellectual Property) participated in the first part of the event which was held in English.
The second part was held in Slovene and intended primarily for all interested librarians. The impact of the implementation of the DSM directive and the expected changes to the Copyright and Related Rights Act, which will affect or may affect the daily practice of working in a library, was presented.

Abstract: Library organisations have long called for our institutions and their users, globally, to enjoy a minimum set of provisions in copyright law that allow them to achieve public interest policy goals in a digital, globalised world. The Directive on Copyright in the Digital Single Market represents a valuable step forwards, with many aspects representing a model for legislation elsewhere. At the same time, its omissions and its failings mean that, arguably, it leaves many loose ends that that merit further action, through national, European, and global reform.
Izvleček: Združenja knjižnic že dolgo pozivajo knjižnice in njihove uporabnike po svetu, da omogočijo uveljavitev minimalnih sklopov določb avtorskega prava za doseganje ciljev politike javnega interesa v digitalnem, globaliziranem svetu. Direktiva o avtorskih pravicah na enotnem digitalnem trgu predstavlja pomemben korak naprej, s številnimi vidiki pa predstavlja model zakonodaje tudi drugje (izven EU). Hkrati pa nevključeni predlogi in pomanjkljivosti pomenijo, da nedvomno pušča veliko ohlapnih zaključkov, ki si zaslužijo nadaljnje ukrepanje z reformami na nacionalni, evropski in svetovni ravni.
Biography: Stephen Wyber is Manager, Policy and Advocacy at the International Federation of Library Associations and Institutions, part of a team focused both on making the case for libraries at the international level, and supporting Members around the world to advocate effectively for the laws, policies and funding libraries need to fulfil their missions at the regional, national and local levels. The team focuses on a wide range of issues, from copyright to sustainable development, human rights, and the safeguarding and promotion of culture and heritage. He joined IFLA in 2016, having previously worked on social issues at the UK Embassy in Paris, and on trade, innovation and investment issues at the UK Delegation to the Organisation for Economic Cooperation and Development.
Biografija: Stephen Wyber je menedžer s področja politike in zagovorništva v Mednarodni zvezi bibliotekarskih, društev in ustanov (IFLE), je član skupine, ki se osredotoča tako na uveljavljanje knjižnic na mednarodni ravni kot na nudenje podpore njenim članom. Za učinkovito zagovarjanje zakonov, politik in financiranja knjižnic morajo člani po vsem svetu izpolnjevati svoja poslanstva na regionalni, nacionalni in lokalni ravni. Skupina se osredotoča na široko paleto vprašanj, od avtorskih pravic do trajnostnega razvoja, človekovih pravic ter varovanja in promocije kulture in dediščine. IFLI se je pridružil leta 2016, pred tem se je ukvarjal z družbenimi vprašanji na veleposlaništvu Združenega kraljestva v Parizu, in delal na področju trgovine, inovacij in naložb v delegaciji Združenega kraljestva pri Organizaciji za gospodarsko sodelovanje in razvoj (OECD).

Abstract: This presentation will take a look at the impact of the 2019 Copyright in the Digital Single Market Directive with a special focus on open access to information and culture. What is the impact of the provisions aimed at increasing access to reuse of copyrighted works and how to they relate to the parts of the directive that expand exclusive rights? The presentation will provide a high level overview of the directive from the perspective of the open movement and reflect on the impact open access advocates during the legislative battles over the provisions in the directive.
Izvleček: Predstavitev bo obravnavala vpliv Direktive o avtorskih pravicah na enotnem digitalnem trgu iz leta 2019, poseben poudarek bo namenjen odprtemu dostopu do informacij in kulturnih vsebin.
Kakšen bo učinek določb direktive, namen katerih je zagotavljanje boljšega dostopa do ponovne uporabe del, zaščitenih z avtorskimi pravicami, in kako se določbe povezujejo v delih direktive o širjenju izključnega prenosa pravic? Predstavljen bo pregled direktive z vidika odprtega dostopa in kakšen vpliv so v času zakonodajnih bitk imeli zagovorniki odprtega dostopa na sprejemanje določb direktive.
Biography: Paul Keller is the Policy Director at Open Future. He has almost 20 years of experience as a media activist, open policy advocate and systems architect to improve access to knowledge and culture. A political scientist by training, Paul has a deep understanding of the digital transformation’s political, social and legal implications. Prior to founding Open Future Paul has served for ten years as the co-director of Kennisland, an Amsterdam based think-tank working on issues related to the knowledge economy. Before joining Kennisland in 2007, Paul worked at Waag as head of the Public Research programme. Paul is a research fellow at the Institute for Information Law of the University of Amsterdam and sits on the advisory boards of the Glushko & Samuelson Information Law and Policy Lab and the Europeana Foundation.
In 2009 Paul was one of the founding members of the COMMUNIA association for the Public Domain where he continues to serve as the President. Between 2015 and 2019 Paul has directed COMMUNIAs and Europeana’s advocacy efforts related the Copyright in the Digital Single Market directive. In these roles, he has been instrumental in significantly improving a number of the provisions contained in the directive, including the provisions dealing with the protection of the Public Domain, access to Out of Commerce Works and the controversial new rules for online platforms.
Biografija: Paul Keller je direktor fundacije Open Future. Kot medijski aktivist, zagovornik politike odprtega dostopa in sistemski načrtovalec izboljšanja dostopa do znanja in kulture ima že skoraj dvajset let izkušenj. Po izobrazbi je politolog, zato dobro razume politične, družbene in pravne posledice digitalne preobrazbe. Pred ustanovitvijo Open Future je bil deset let sodirektor Kennislanda, amsterdamske raziskovalno-svetovalne ustanove, ki se ukvarja z vprašanji ekonomije znanja. Preden se je leta 2007 pridružil Kennislandu, je bil vodja javnega raziskovalnega programa pri družbi Waag. Paul Keller je tudi raziskovalec na Inštitutu za informacijsko pravo Univerze v Amsterdamu, član svetovalnega odbora pri Glushko & Samuelson Information Law and Policy Lab in pri Fundaciji Europeana. Leta 2009 je bil med ustanovnimi člani združenja COMMUNIA, ki spodbuja digitalno javno domeno, trenutno je predsednik združenja. Med letoma 2015 in 2019 je zastopal prizadevanja COMMUNIE in Europeane v zvezi z Direktivo o avtorskih pravicah na enotnem digitalnem trgu. V svojih vlogah je pomembno prispeval k izboljšanju številnih določb direktive, vključno s tistimi, ki se nanašajo na varstvo javne domene, na dostop do razprodanih del in na nove, sporne predpise za spletne platforme.

Abstract: The EODOPEN project, that started in November 2019 and is carried out by 15 libraries from 11 European countries, focuses on bringing digitally-hidden works to the public forefront by digitizing and making them available on a pan-European level whilst fully respecting current copyright regimes. One aim of the project is to address legal insecurities as an “innovation barrier” for making available 20th and 21st century cultural heritage. The EODOPEN project builds upon the partnership and infrastructure of the eBooks on Demand (EOD) Network, established in July 2008 and by now a self-sustained network. This presentation presents the project and addresses lessons learned so far – particularly regarding the projects work concerning legal aspects.
Izvleček: Projekt EODOPEN, ki se je začel novembra 2019 in ga izvaja 15 knjižnic iz 11. evropskih držav, se na vseevropski ravni osredotoča na digitalizacijo in zagotavljanje dostopa do javnosti skritega gradiva, ob tem pa v celoti spoštuje veljavno zakonodajo s področja avtorskih pravic. Med cilji projekta je tudi reševanje pravne negotovosti kot "inovacijske ovire" za zagotavljanje dostopa do kulturne dediščine 20. in 21. stoletja. Projekt EODOPEN temelji na partnerstvu in infrastrukturi mreže Digitalizacija knjig po naročilu (EOD), ki je bila vzpostavljena julija 2008, in je postala neodvisna storitev. Predavanje predstavlja projekt ter obravnava dosedanja spoznanja, predvsem pravne vidike, povezane s projektom.
Biography: Dr Christopher Natzén have been employed as a research officer at the National Library of Sweden since September 2009. He has extensive experience of working with EU Commission-funded projects. Between 2009 and 2012 he was involved in the three-year eContentPlus project EUscreen (ECP 2008 DILI 518002) aimed towards providing open access to television content from national archives on the web. He also worked on the successor to this project, EUscreenXL which ran from 2013 to 2016 and was funded through CIP (CIP-ICT-PSP 2012.2.1). From January 2014 he was project leader of one of EUscreenXL’s work packages “Contextualisation, User Engagement and Evaluation”. In EODOPEN he is the leader of working group 5 “Rights clearance assessment and support”. As of January 2021, he is the research strategist at the National Library of Sweden.
Biografija: Dr Christopher Natzén je od septembra 2009 zaposlen kot raziskovalec v švedski Nacionalni knjižnici. Ima bogate izkušnje z delom na projektih, ki jih financira Evropska komisija. Med leti 2009 in 2012 je sodeloval v triletnem projektu eContentPlus EUscreen (ECP 2008 DILI 518002), namenjenemu zagotavljanju odprtega dostopa na spletu do televizijskih vsebin iz nacionalnih arhivov. Delal je tudi pri projektu EUscreenXL, ki je potekal od leta 2013 do 2016 in je bil financiran iz programa CIP (CIP-ICT-PSP 2012.2.1), ter je nadaljevanje projekta eContentPlus EUscreen. Od januarja 2014 je bil vodja delovnega sklopa projekta EUscreenXL »Kontekstualiziranje, vključevanje uporabnikov in vrednotenje«. V projektu EODOPEN je vodja delovne skupine 5 - »Razčiščevanje avtorskih pravic: ocenjevanje in podpora«. Od januarja 2021 je vodja raziskav v švedski Nacionalni knjižnici.

Abstract: Digitisation has provided us the solution to share knowledge and information in a way as quick and convenient as never before. Since libraries started to make use of this technology they have been facing the problem of how to embrace this opportunity to make those parts of their digital cultural heritage available to the large public which are still protected by copyright. Legislators tried to solve this problem by introducing various exceptions and limitations to copyright, with more or less success. We expect that implementation of the out-of-commerce regime provided by the DSM directive will effectively influence mass digitization projects at cultural heritage institutions in Europe. As for Hungary, a new national digital content service with a copyright clearance infrastructure is under design in order to exploit OOC regime for making digitized copyrighted materials accessible to online users all around the world.
Izvleček: Digitalizacija nam, kot še nikoli doslej, zagotavlja hitro in uporabno rešitev za izmenjavo znanj in informacij. Odkar knjižnice izvajajo digitalizacijo, se vseskozi soočajo s problemom, kako izkoristiti priložnosti in širši javnosti zagotoviti dostop do kulturne dediščine, ki je še vedno zaščitena z avtorskimi pravicami. Zakonodajalci so bolj ali manj uspešno poskušali rešiti težavo z uvedbo različnih izjem in omejitev avtorske pravice. Pričakujemo, da bo izvajanje ureditve razprodanih del, v skladu z Direktivo o avtorski in sorodnih pravicah na enotnem digitalnem trgu (DSM), učinkovito vplivalo na projekte množične digitalizacije v ustanovah za varstvo kulturne dediščine v Evropi. Na Madžarskem je v postopku načrtovanja nova nacionalna storitev za razčiščevanje avtorskih pravic digitalnih vsebin, ki bi ustanovam za varstvo kulturne dediščine omogočila digitalizacijo razprodanih del ter dostop do teh del uporabnikom spleta po vsem svetu.
Biography: Szabolcs Dancs works as chief advisor at National Széchényi Library of Hungary. He is also the head of Office for Library Standards at the Hungarian Library Institute and external consultant for Digital Humanities Center at Petőfi Literary Museum. Previously he held the position of Director of Collection Development and Project Director at NSL. He was involved in EU funded projects such as Linked Heritage and ARROW. He leads a work group which aims at implementing the new cataloguing standard (Resource Description and Access, RDA) in the country. Also, he is a metadata expert, member of the editorial committee of two leading library journals in Hungary and one in Slovakia. He has been publishing articles in the area of digitization, copyright, standardization, etc. for 17 years.
Biografija: Szabolcs Dancs je glavni svetovalec v madžarski Nacionalni knjižnici Széchényi, vodja Urada za knjižnične standarde na Madžarskem inštitutu za knjižničarstvo in zunanji svetovalec Centra za digitalno humanistiko v literarnem muzeju Petőfi. Pred tem je bil direktor za razvoj zbirk in direktor projektov pri Nacionalni knjižnici Széchényi. Sodeloval je pri projektih, ki jih je financirala EU, kot sta Linked Heritage in ARROW. Na Madžarskem je vodja delovne skupine, katere cilj je izvajanje novega mednarodnega katalogizacijskega standarda (RDA). Je tudi strokovnjak za metapodatke, član uredniškega odbora dveh vodilnih knjižničnih revij na Madžarskem in na Slovaškem. Že 17 let objavlja članke s področja digitalizacije, avtorskih pravic, standardizacije itd.
Abstract: This presentation will guide the listeners through the implementation process of the DSM Directive in Slovenia. It will focus on the exceptions and limitations to the copyright, as they are currently in force, while providing information on the content of the draft laws ZASP and ZKUASP, which were published at the end of May of this year. Maja will at the same time critically evaluate the published draft laws and point out the better ways to amends certain articles, concerning exceptions and limitations from perspectives of educators.
Izvleček: Predstavitev bo poslušalce vodila skozi postopek sprejemanja direktive DSM v Sloveniji. Osredotočila se bo na izjeme in omejitve avtorskih pravic, kot so trenutno v veljavi, hkrati pa podala informacije o vsebini osnutkov Zakona o avtorski in sorodnih pravicah (ZASP) in Zakona o kolektivnem upravljanju avtorske in sorodnih pravic (ZKUASP), ki sta bila objavljena konec maja letos. Maja Bogataj Jančič bo hkrati kritično ocenila objavljene osnutke zakonov in opozorila na boljše načine spremembe nekaterih členov direktive, ki se nanašajo na izjeme in omejitve za izobraževalne ustanove.
Biography: Dr Maja Bogataj Jančič is the founder and head of the Intellectual Property Institute, a private research, training and consulting institution based in Ljubljana, Slovenia. She graduated from the Faculty of Law in Ljubljana (1996) and obtained her Master’s degree at the Faculty of Law in Ljubljana (1999, Economy), at Harvard Law School (2000, Law) and at the Faculty of Law in Turin (2005, Intellectual Property). She also holds a Doctoral degree from the Faculty of Law in Ljubljana (2006, Copyright). She authored many publications in the field of intellectual property and co-author of various books regarding the internet and intellectual property law.
Her research and academic work is focused on intellectual property, especially copyright. She participates in different international projects. Maja is an arbitrator in alternative dispute resolution proceedings for the resolution of domain name disputes regarding the use of the top-level domain .si and a representative for trademarks and designs.
She was in charge of the project Creative Commons Slovenia and since 2019 she is Representative in the Creative Commons Global Network and a Legal Lead of the Slovenian Chapter. She is also a member of the Communia association that advocates the expansion of the public domain and the increased access to and reuse of culture and knowledge. Maja’s work has recently focused on data management and AI, especially copyright issues related to machine learning, data governance and AI. She is a co-chair of the data management working group at the Global Artificial Intelligence Partnership (GPAI)

Je diplomantka Pravne fakultete v Ljubljani (1996). Magistrirala je na Pravni fakulteti v Ljubljani (1999, ekonomija), na Harvard Law School (2000, pravo) in na Pravni fakulteti v Torinu (Facoltà di Giurisprudenza di Torino (2005, intelektualna lastnina). Doktorirala je na Pravni fakulteti v Ljubljani (2006, avtorsko pravo). Je avtorica številnih člankov s področja intelektualne lastnine in soavtorica več knjig s področja interneta in prava intelektualne lastnine. Njeno raziskovalno in svetovalno delo je osredotočeno na intelektualno lastnino, zlasti avtorsko pravo. Sodeluje pri številnih mednarodnih projektih. Je razsodnica v postopkih za alternativno reševanje domenskih sporov za domenski prostor .si in zastopnica za znamke in modele.
Vodila je projekt Creative Commons Slovenija, od leta 2019 je predstavnica in pravna vodja slovenskega chapter-ja v mreži Creative Commons Global Network.
